Terms of SERVICE

ICCI - International Cannabis and Cannabinoids Institute s.r.o., BIN: 03 136 621, Jachymova 26/2, Stare Mesto, 110 00 Praha 1, Czech Republic, a Czech limited liability company registered in the Commercial Register maintained by the Municipal Court in Prague under file No.: C 227925 ("ICCI") provides number of services through its series of websites at icci.science domain ("ICCI Website"). These Terms are applicable to all these services and other related services ("Services"), while their respective differences and specifics are described below. Services are available to anyone who is able to access them on the ICCI Website ("Customers").

Services

  1. ICCI Education

We provide education in the area of medical cannabis, cannabis and related topics ("ICCI Education"). ICCI Education consists of two services; one being provided by The Answer Page, Inc. ("TAP"), which provides professional education recognised and accepted by American Medical Association and UEMS-EACCME® ("TAP Courses") and the other by ICCI, which provides legislative and regulatory information related to legal use of marijuana for medical purposes in a number of jurisdictions worldwide and giving fundamental information about medical cannabis ("Country Specific Information"). Both TAP Courses and Country Specific Information are complemented by each other and we encourage combining their content for further education.

Country Specific Information is accessible to anyone through a registration at ICCI Website by choosing either "PATIENT" or "MEDICAL PROFESSIONAL" registration.

By choosing "PATIENT" registration, ICCI provides to such users Country Specific Information and introductory videos.

By choosing "MEDICAL PROFESSIONAL" registration, ICCI provides to such users same services as "PATIENT" user and also the possibility to list their practice in a public database. In order to get listed in this public database, medical professionals have to successfully complete any TAP Course. Upon completion and consent, their profile is automatically added to the public database of medical professionals within a week after fulfilling requirements.

TAP Courses are accessible on the TAP website through a redirection from ICCI Website or solely by independent browsing.

  1. ICCI Webinars

One of ICCI's services is organizing online webinars through the platform of Zoom Video Communications, Inc. ("Webinars") with leading professionals, either affiliated or not affiliated with ICCI, as speakers ("Speakers"). Topic of every Webinar is scheduled in advance and is connected to the know-how of each respective Speaker, always connected to ICCI's area of interest. Webinars do not have a limitation on the number of viewers nor is there a requirement on the background of viewers themselves.

Webinars are provided both for free or paid. Paid Webinars are made available to Customers through e-mail after a successful payment (see Payments below).

Although ICCI puts significant effort into observing relevant credentials of every potential Speaker, ICCI is not responsible nor give any warranties about Webinars and their content (see Errors and Omissions below).

Webinars might be re-scheduled due to unforeseen events such as illness or force majeure. In those cases, Customers will be informed about time and date of the new rescheduled Webinar as soon as possible and also will be entitled to a reimbursement should they choose to not attend the Webinar any longer.

Payments

ICCI provides certain Services as a pay to access. When encountered with such Service on the ICCI Website, Customers can access that Service by paying designated price through:

  1. Paypal;

  2. GoPay.

When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the Service, you agree to pay us the corresponding fees within thirty (30) days of notification from us. We reserve the right to disable access to any Service for which we have not received adequate payments.

All payments are finalised and Service is made available only after they have been credited to ICCI account.

All prices are inclusive of VAT and final.

Consumer Protection and Claims

Customers, who do not use our Services in their professional capacity or in the course of their business, but are natural persons acting in their own private manner are to be considered consumers with respective legal rights ("Consumers").

In the meaning of applicable law, ICCI provides this information:

  1. ICCI is the only seller of Services;

  2. price and specification of each Service is provided above and is inclusive of VAT and other taxes;

  3. Consumers have no rights from the inability to connect to ICCI Website due to network errors;

  4. Consumers can also raise their claims in front of Czech Trade Inspection Authority ("CTIA");

  5. agreement can only be written in English language;

Consumers agree that if the access to Services is provided by ICCI right after a successful payment (should the Service be pay to access), the Service is non-refundable.

In some cases, Service is provided only after certain period of time and Consumers are able to return purchased Service within the time period set by Czech Civil Code (14 days after the day that the Service was purchased). If you purchased a Service that has a postponed delivery and would like to exercise your consumer rights, please contact us through +420 774 151 777 or marketa.adamikova@icci.science. ICCI will return the payment within 14 days after your withdrawal.

If a part of Service was already provided to the Consumer before exercising consumer rights, ICCI will only refund that part of the Service that was not provided before such exercise of consumer rights. ICCI will return such payment within 14 days after your withdrawal;

  1. Terms represent the whole agreement between ICCI and Consumer and are always available online at ICCI Website;

  2. technical steps needed to enter into agreement with ICCI are described in respective Services sections above, Consumers will always be able to make amendments to the order form before sending it to ICCI;

  3. under the Act. No. 634/1992 Coll. on Consumer Protection, the Customer is entitled to Alternative Dispute Resolution (ADR) of disputes arising from these Terms as well as any agreement with ICCI. The body responsible for ADR is Czech Trade Inspection (http://www.coi.cz). You can also find information about alternative dispute resolution on the European online-platform for dispute resolution at: https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage.

Errors and Omissions

These Errors and Omissions do not apply to Consumers. Instead, Czech statutory regulation applies.

Applicable Law

The terms of use of the Services are governed by Czech law. This choice, however, doesn't pose the result of depriving the Consumer of the protection afforded to him by provisions that cannot be derogated from by agreement by virtue of the law which, in the absence of choice, would have been applicable on the basis of his/her habitual residence.

Jurisdiction

Czech civil courts have full jurisdiction in all matters arising from these Terms or agreements thereof. If the agreement has been concluded with a Consumer with domicile in a different European Union Member State ("Member State") and ICCI pursues commercial or professional activities in the Member State of the Consumer's domicile or, by any means, directs such activities to that Member State or to several States including that Member State, and the contract falls within the scope of such activities, Consumer may also invoke the jurisdiction of that Member State.
